These Terms of Service ("Terms") govern your access to and all use of GetYour.iD’s website, products, and services ("Products"). Our products are offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies including, without limitation, our Privacy Policy, Registries Policies and procedures that may be published from time to time by GetYour.iD collectively, the (“Agreement”). BY ACCESSING OR USING OUR PRODUCTS, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS AND BY OUR PRIVACY POLICY.

Use of GetYour.iD

Our Products are not directed to children younger than 18 years of age, access and use of our Products is only offered to users 18 years of age or older. Anyone who registers as a user must be an identifiable individual of 18 years of age or older, or a legally constituted organisation. If you are under 18 years old, please do not register to use our Products.

Translation

These Terms of Service were originally written in English. We may translate these terms into other languages. In the event of a conflict between a translated version of these Terms of Service and the English version, the English version will prevail.

Comply with any orders of any authority having jurisdiction in relation to the Products.

Comply with your lawful directions in a diligent and timely manner in relations to the Products including, not limited to registration, amendment, cancellation, deletion and any other that is associated with technical support and billing enquiries.

Use your personal information only as authorised by you and otherwise, in accordance with this Terms of Service and our Privacy Policy.

Take all reasonable steps to provide safeguard and protect your personal information stored in our application systems, servers, and database.

Your Obligations

You will ensure all information you provide to GetYour.iD is accurate, complete and correct, and keep us informed for any update on the information you provide us.

You will only use the Products for lawful purposes and will not use the Products to engage in any activities such as distribution of malware, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting or otherwise engaging in activity contrary to applicable law. Should such activity occur of any of the Products held by you, GetYour.iD reserves the right to cancel, suspend the Products held by you and disable or lock your user account with us.

You will comply with any orders of any authority having jurisdiction in relation to the Products.

You will ensure the security of any passwords associated with the Products such as domain password, user account password, once provided to you. You must ensure your password information is kept confidential, safe and secure at all time. GetYour.iD is not responsible for the misuse of any password information whether by yourself or by any other person including, not limited to any employee or contractor of GetYour.iD.

You will fulfil and continue to meet the eligibility criteria for the registration of Restricted Domain Name during the lifetime of the domain name.

You will agree that GetYour.iD reserves the right to take any actions that is reasonably necessary or prudent to comply with all relevant Policies or any such instructions received from time to time from the registries without incurring any liability to you or any person for whom you are responsible.

Fees and Charges

All fees and charges for our Products are published on our web site. We maintain the ability to change them at will.

All fees and charges are displayed exclusive of applicable taxes and surcharges. Any applicable amounts will be included in the total amount on the final step of shopping cart prior to order completion. By proceeding with order completion you agree and authorise to the displayed amount being either charged from the selected payment method or required to be processed by you as a manual payment for example wire transfer.

Charges for Products are those published at the time you request for the Products. Special, promotional or bundled pricing for particular Products may be limited on a per year, member, or email address basis; prices displayed after account login and prior to payment will indicate eligibility for such pricing.

You agree to pay for all the Products you request and/or use. Fees that you pay are non-refundable, except where we have expressly consented otherwise.

You agree that failure to pay or failure of payment being honoured will void your application and relieve us of any responsibility with regards to the provision of the Products applied for.

Payment Chargebacks

You cannot seek to reverse a payment (chargeback) in your favour. We may hold you to the transaction, resist the chargeback, and charge you reasonable costs for doing so. We hold the right to suspend and/or cancel your service and decline you from any further services until all applicable costs have been paid.

Credits and Withdrawals

Credit line or prepaid account is available inside each user account. We provide this prepaid account facility for those who wish to activate AutoRenew feature for each of your registered product with us. You can create as well as top up your account at any time and maintain a positive balance at all time in order to avoid failure to register a new product or renew your already registered product. A fee of 2% from the total amount withdrawn from your prepaid account will be charged when transferring the amount out to your nominated banking institutes including your PayPal account.

You can setup a credit line facility in your account and topup at any time, 2% fee is applicable when you withdraw.

Auto Renewal Feature

Your purchase includes an opt-in to our auto renewal feature. This keeps your products and services up and running by automatically charging the current renewal fees to your preference payment method before they are expired, with no further action on your part.

You may cancel this service at any time by turning off the auto renewal feature in your account profile as default and as well as to the products from the manager list. You may receive a notice to the email address you provided to us, ahead of auto renewal process.

By opting in, or not opting out of auto renewal feature, you agree to be bound by all applicable terms, conditions, policies and procedures which apply to product renewed as they are published within this document.

Termination

GetYour.iD may terminate your access to all or any part of our Products at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your GetYour.iD account (if you have one), you may submit a request by contacting us or simply discontinue using our Products. All provisions of this Agreement which by their nature should and shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Indemnity

You agree to indemnify and hold harmless GetYour.iD, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of our Products, including but not limited to your violation of this Agreement.

You should not violate this agreement in any way and if you do, you will not hold us accountable for your action.

Disclaimer of Warranties

Our Products are provided “as is.” GetYour.iD and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement.

Neither GetYour.iD nor its suppliers and licensors, makes any warranty that our Products will be error free or that access thereto will be continuous or uninterrupted.

We always do the best to provide our products and services but sometime things may go wrong. When it does, rest assured that we will do the best to fix the problem.

Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GetYour.iD SHALL NOT BE LIABLE TO YOU OR YOUR BUSINESS FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF THE USE OF THIS SITE OR ANY PRODUCTS OR SERVICES PROVIDED, WHETHER INCURRED DIRECTLY OR INDIRECTLY. WHETHER LIABILITY IS ASSERTED IN CONTRACT OR TORT (INCLUDING NEGLIGENCE AND STRICT PRODUCT LIABILITY) AND IRRESPECTIVE OF WHETHER YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH LOSS OR DAMAGE. EACH PARTY HEREBY WAIVES ANY CLAIMS THAT THESE EXCLUSIONS DEPRIVE SUCH PARTY OF AN ADEQUATE REMEDY.

Arbitration, Governing Law and Jurisdiction

These Terms shall be governed by the laws of the Commonwealth of Australia, without regard to its conflict of laws principles.

For any dispute you have with GetYour.iD, you agree to first contact us and attempt to resolve the dispute with us informally. If we have not been able to resolve the dispute with you informally, we each agree to resolve any claim, dispute, arising out of or in connection with or relating to these Terms, shall be referred to and finally resolved by binding arbitration under a recognized arbitrator or law court of the Commonwealth of Australia, and you hereby consent to jurisdiction and venue in the Commonwealth of Australia.

Changes to Terms of Service

At GetYour.iD, we are constantly updating our Products. GetYour.iD reserves the right to amend these Terms of Service from time to time under which our Products are offered. The most current version will always be posted on our website. GetYour.iD also have the right to determine the form and means of providing notifications to you prior the changes take effect.

By continuing to access or use the Products after the changes become effective, you agree to be bound by the revised Terms of Service. If you do not agree to the updated terms, please stop using the Products.

General Terms

Assignment. These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by GetYour.iD without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.

Entire Agreement/Severability. These Terms, together with the Privacy Policy and any amendments and any additional agreements you may enter into with GetYour.iD in connection with the Products, shall constitute the entire agreement between you and GetYour.iD concerning the Products. If any provision of these Terms is deemed invalid, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

No Waiver. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and GetYour.iD's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
